The Kitsap THRIVE Court is an optional diversion program for survivors of trafficking, exploitation, and/or abuse. It is not intended to serve every applicant with these experiences nor is it intended to serve individuals who do not wish to participate. The prospective participant must live within Kitsap County during their participation in the program. A prospective participant's race, gender, age, religious affiliation, sexual orientation, or national origin will never be considered when determining his or her eligibility. The prospective participant must meet the following criteria to be eligible:
A. Diagnosis
- The prospective participant must be diagnosed with a trauma-related behavioral health condition resulting from experience(s) of trafficking, exploitation, and/or abuse.
I. If no diagnosis is documented, the defendant will be referred to the community for a mental health evaluation and treatment recommendations prior to further consideration.
II. It is preferred that defense counsel obtain and provide proof or documentation of an eligible diagnosis with their application. - The prospective participant's trauma-related behavioral health condition contributed, at least in part, to the commission of the criminal offense(s) that brings him/her before the court.
- Be competent per RCW 10.77.
- The prospective participant must be high risk/high needs on a standardized risk assessment tool.
B. Crime Related Eligibility
The following, if present in the current case or criminal history, will automatically preclude the prospective participant's eligibility:
- Any sex offense;
- Any serious violent offense;
- Promoting prostitution;
- Any offense involving death, or resulting in great bodily harm to a victim;
- Delivery of a Controlled Substance to a Minor;
- Currently serving a DOSA/FOSA sentence;
- Prior Adult Therapeutic Court participant from this county or any count's therapeutic court when the date of the current offense is less than three years from the date of graduation or termination. (Past adult therapeutic court graduates admitted into the program will not earn a dismissal of the charges after completion of the program. Instead, the State will recommend an exceptional sentence downward of no jail/prison incarceration time.);
- Violent Traffic Offenses, DUI and Felony DUI;
- A Restitution obligation to a non-commercial victim that exceeds or will likely exceed $2000. This limit does not include restitution obligations to insurance companies, businesses, or other corporate entities. Restitution to individual victims must be paid in full prior to graduation.
- Other offenses listed in RCW 2.30.030.
C. Other Eligibility Factors
- Significant criminal history, including juvenile;
- Age of criminal history;
- Victim input;
- History of compliance while on supervision, e.g., DOC;
- Previous opportunities at recovery, including previous DOSA;
- Major crime as determined by the prosecutor's office, when take as a whole;
- History of failures to appear, bench warrants, bail jumping and escape charges;
- Prior Adult Therapeutic Court participation;
- The presence of aggravating circumstances listed in RCW 9.94A.535;
- Entry of omnibus order or litigation of substantive motion;
- Age of case and delay in application;
- Severe medical issues or mental disorder that would impair the ability to participate fully and comply with program rules and requirements.
